There has been long-standing uncertainty regarding permissible structure/function claims for supplements. The 1998 Federal Trade Commission (FTC) publication “Dietary Supplements: An Advertising Guide for Industry” has been one of the few government publications on this topic, but it leaves much unstated. For the first time in nearly a quarter century, the FTC updated its guidance with the Health Product Compliance Guide released in December 2022, loaded with 50+ examples of permissible vs. impermissible claims. Some say this signals a forthcoming wave of FTC crackdowns, others say that fear is overblown. Everyone agrees that the quality of data needed for claims, and the risks from making claims, will be higher going forward.
